If you have been left out of a Will, or have not been properly provided for in a Will there may be options available to you.

Estate disputes can often arise if a Will was not properly drafted, if the Will maker lacked mental capacity at the time the Will was executed, or if there was fraud, forgery, or undue influence.

If you believe that your benefit under a Will is inadequate, your options are to:

  • Negotiate with the executor for a further legacy
  • Make an application to challenge the Will

Challenges can often be made without resorting to the expertise of a Court based litigation.

If you are an executor, co-executor or trustee of a Will and are having problems with the family or nominated beneficiaries in the Will, you need to seek legal advice. Leesa has a long history of acting in estate dispute resolution matters and is able to advise on your options, and defend the Will on your behalf.
